Terms and Conditions

Welcome to 2HEX.com. By accessing our website and using our services, you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please do not use our website and services.


1. Introduction

2HEX.com specialises in providing custom products to companies mainly in the United States and Europe, with production facilitated through our partners in China. All products are shipped directly from China except if stated otherwise by a 2HEX representative.


2. Use of Website

This website is offered to you for your business use. You agree to use this site in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions outlined here.


3. Product Orders

  1. All orders are subject to acceptance and availability.
  2. Prices and availability of products are subject to change without notice.
  3. Custom orders may have specific terms that will be communicated during the ordering process.
  4. The full payment for all orders must be paid at the latest within two months after 2HEX has completed the production. If the customer fails to pay the full balance, the goods fully belong to 2HEX.
  5. In order to ensure the delivery of the desired amount of products and to compensate for items that may not pass quality control, 2HEX may produce an additional 5% more products than ordered. By placing an OEM order with 2HEX, the customer acknowledges and agrees that a variance of ±5% in product quantity may be produced, and invoiced and charged upon completion of production.

4. Shipping and Delivery

  1. Products are shipped directly from China except if stated otherwise by a 2HEX representative. Delivery times may vary based on your location and custom production times.
  2. If shipping costs are not mentioned, it means that the shipping terms are ExWorks. Meaning that 2HEX does not pay for shipping.
  3. You are responsible for any customs, duties, or taxes imposed by your country.

5. Payment

  1. Payment must be made in full within two months after production is completed. Orders not paid on time will incur storage fees, interest fees, and late fees, which are subject to 2HEX's calculations.
  2. In the event that a payment is to be returned, 2HEX will deduct bank fees incurred for both receiving and returning the customer's payments, along with reasonable administration costs, from the amount refunded to the customer.

6. Cancellations and Refunds

  1. Cancellations are permitted solely prior to the commencement of production. Once production is underway, we are unable to accept cancellations.
  2. 2HEX reserves the right to choose between repairing, replacing, or refunding for defective products or parts thereof, based on what we deem most appropriate.
  3. We offer replacements, repairs, or refunds exclusively for products or parts thereof that are defective or have production errors for which 2HEX is responsible. Requests for refunds must be submitted within 7 (seven) days following the receipt of the product(s).
  4. Customers are required to return defective products to the 2HEX warehouse in Guangzhou, China, at their own expense in order to qualify for a refund, replacement, or repair.
  5. Following the repair or the provision of replacement parts, it is the customer's responsibility to either arrange for the pickup of these goods or to cover the cost of shipping.
  6. Please note that 2HEX does not cover the shipping costs for returning defective products, nor the delivery of repaired or replaced items back to the customer.

7. Intellectual Property

  1. You guarantee that all designs or instructions provided for custom products do not infringe on any intellectual property rights.
  2. You grant 2HEX a non-exclusive, royalty-free license to use, reproduce, and modify your designs as necessary for product production.
  3. 2HEX has the right to throw out, give away, or sell goods that have not been completely paid for to other customers or buyers, even without removing any of the customer’s components, artworks, logos, or brand names.

8. Limitation of Liability

2HEX will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of the use or inability to use our products or services, including but not limited to damages to objects and personal injury to individuals. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if 2HEX has been advised of the possibility of such damage.


9. Indemnification

You agree to indemnify, defend, and hold harmless 2HEX and its partners from any claims, liabilities, expenses, or damages arising from your use of the website and products or your violation of these terms and conditions.


10. Changes to Terms and Conditions

  1. We reserve the right to modify these terms and conditions at any time. Your continued use of the website after such changes constitutes your acceptance of the new terms.
  2. All terms and conditions can be re-negotiated before you place your order. Any changes must be confirmed by a 2HEX employee by email and clearly titled as "changes to 2HEX terms and conditions"

11. Governing Law

• All contracts and agreements are made under German law.
• The exclusive court location for all disputes is Ulm, Germany.
• You will not use any court outside of Ulm, Germany to dispute against or sue 2HEX.

  2. If you do not agree with these terms and conditions, email the 2HEX team. Only if a 2HEX sales manager by email states that he or she revokes or changes specific terms and conditions for a specific order, will the change take effect.

13. Acceptance of Terms

If a customer does not use moulds, cliches, or screens kept at 2HEX for 1 year or more, 2HEX has the right to re-use these for other customers, sell them as raw material, or throw them out. Moulds and screens are usually kept on stock for at most one year.

By using this website and placing orders, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.


14. Use of Services and Website

  1. By using our services and accessing our website, you acknowledge and consent to 2HEX's use of Cookies and third-party code to enhance your user experience and improve our services.
  2. You agree to the jurisdiction of the district court of Ulm, Germany, for the resolution of any disputes arising under these terms and conditions.

15. Product Availability and Orders

  1. The availability of products listed on 2HEX.com is not guaranteed. We reserve the right to decline orders or offer alternatives if the requested products are not available.
  2. We may cancel orders and process refunds at our discretion at any point before shipping.
  3. Production times provided on our website or by a 2HEX representative are estimates. Actual times may vary based on current demand, production capacity, and unforeseeable production problems.

16. Communication

  1. While we strive to respond to all inquiries within 48 hours, we cannot guarantee this response time.
  2. By engaging with our services, such as registering on our site, ordering samples, downloading templates, mockups, ebooks, or other content, or simply by contacting us, you consent to being added to our newsletter distribution list. We will use your contact information to send emails, messages, and make calls related to 2HEX updates, promotions, and information that may benefit your business until you opt to unsubscribe. Our newsletters are sent irregularly, but we encourage you to read through at least one or two issues before deciding to unsubscribe, as they may contain valuable insights for your business.

17. Consumer Rights for Purchases from the Samples Shop/Webshop

Right to Cancel and Return Policy

Customers having bought pre-manufactured, none-customized products have the right to cancel their order for any reason within 14 days from the day they physically receive the goods. To initiate a cancellation, customers should notify 2HEX of their decision with a clear statement. This can be done by sending an email to the address provided by 2HEX in our post-order communication, or through the contact form available on the 2HEX website.

Refund Policy

Upon cancellation and receiving back the goods, 2HEX will refund the payment received for the goods, excluding

  1. Delivery Charges: Due to the high costs associated with international shipping of heavy goods, the initial delivery charges are non-refundable.
  2. Customs Charges: Any Chinese customs charges incurred when goods are returned to China will be subtracted from the refund amount.
  3. Bank Charges: Bank charges associated with receiving and returning payments will also be deducted from the refund amount.
  4. Administration Costs: Reasonable administration costs incurred in processing the order and the subsequent cancellation will be deducted.
  5. Diminished Value: The customer is liable for any diminished value of the goods. This amount will be deducted from the refund.

Exclusions from the Right of Withdrawal

  1. Custom and Personalized Products: Products made to the consumer’s specifications or clearly personalized, such as custom printed decks, are not eligible for a return or refund.
  2. Digital Content and Services: There is no right of withdrawal for purchases of digital content or services once the delivery or access has commenced with the consumer’s prior express consent and acknowledgment of the forfeiture of their withdrawal right.

Return Costs and Procedure

The customer must bear the direct cost of returning the goods and any associated customs charges. Goods can only be returned to 2HEX's address in Guangzhou, China, which will be provided to customers upon request. Goods must be returned without undue delay and in any event not later than 14 days from the day on which the withdrawal from the contract is communicated to 2HEX. Payments are only reimbursed after 2HEX has received the goods — not when they are received by the carrier or any other party. The customer is liable for any diminished value of the goods resulting from handling the goods.

Procedure for Exercising Rights

For initiating a return or cancellation, customers should contact 2HEX directly at the provided contact details, including order information and the reason for return or cancellation.


18. Severability

Should any provision of these Terms and Conditions be deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the other provisions of these Terms and Conditions, which shall remain in full force and effect. In such cases, the parties agree that the invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely achieves the original intent and economic effect of the invalid or unenforceable provision.
